When justice becomes injustice, resistance becomes duty.

 In keeping with this famous watchword of Bert Brecht, I join in supporting the letter from Ursula Haverbeck, Dr. Rigolf Hennig und Wolf von Stephani, which is posted at <http://de.altermedia.info/general/aufruf-zur-freilassung-von-horst-mahler-18-12-10_58469.html>.
I am now circulating this letter as a petition in support of their demands.

It is high time to rise up and resist the massive violations of human rights raging here in Germany.
Today it is Horst Mahler who has been sentenced to eleven years' incarceration for nonviolently expressing dissenting political opinions -- tomorrow it could be you!
Therefore I ask that all recipients of this message not only sign the petition, but forward it to his or her comrades, friends and acquaintances all over the world.
We Germans have been robbed of our human rights for too long!

You do not have to be a German citizen to support human rights in Germany and join the struggle for
EINIGKEIT UND RECHT UND FREIHEIT

English Version of the Petition To Free Horst Mahler

As we all know, Liu Xiaobo received the Nobel Freedom Prize this year for his courageous critique of the Chinese state and for his uncompromising commitment to human rights.
The Chinese government ignores the basic human rights of freedom of opinion, freedom of the press and freedom of artistic expression, even though their constitution provides for all these freedoms.
Liu Xiabao refuses to accept the contradiction between his government's pretended regard for human rights and its actual policy of repression.
In the view of the Chinese rulers, Liu Xiaobo has broken the law and disparaged the State, therefore he has been branded a criminal and sentenced to eleven years' incarceration.

The governments and media in the Western world rightly celebrate Liu Xiaobo as a hero.
The DPA (German Press Agency) quotes Thorbjoern Jagland, President of the Nobel Committee, as making the following statement:
"The Chinese Constitution guarantees its citizens freedom of the press, freedom of speech and freedom of assembly as well as the right to criticize their government.
Liu has done nothing except exercize these rights, and he must be released." (Quotation from WESTFALEN-BLATT for Sunday, 11 December 2010)

Horst Mahler committed the same offense in Germany that Liu Xiaobo committed in China: He criticized the State!
He dared to make use of his guaranteed right to disparage the "Federal Republic of Germany."
When we read the depictions of Liu Xiaobo's case in the Western press, the following  unmistakable message comes through loud and clear:
The sentencing of Horst Mahler to 12 years' incarceration is unlawful prima faciae!

The motion to review the Mahler case was submitted several weeks ago.
 We hope and we expect that after this indirect criticism of German jurisprudence in its treatment of Horst Mahler, criticism that is so strong it cannot be ignored, this scandalous verdict will be lifted without delay.

Germany's treatment of its citizen critics is comparable to China's.
It is all too clear that those who are responsible for the German policies are either complete hypocrits or else they have established a Chinese style dictatorship.
Therefore, we demand Mahler's release in the New Year, without further formalities.
Additional trials would only confirm the public's worst suspicions of institutionalized injustice in the "Federal Republic of Germany."
Whoever supports EINIGKEIT UND RECHT UND FREIHEIT  ("Unity, Justice and Freedom"  - the German National Anthem) and wants to be able to sing it with good conscience, should put his signature to this demand for the immediate release of Horst Mahler.

Appel pour la libération de Horst Mahler

Liu Xiaobo a reçu cette année le Prix Nobel de la Paix pour sa courageuse critique de l'Etat chinois et pour son engagement sans réserve en faveur des libertés légitimes de l'homme.

La politique chinoise ignore la liberté d'expression, la liberté de la presse et la liberté de l'art, bien que celles-ci soient prévues par la Constitution. Xiaobo n'accepte pas cette contradiction. Mais les dirigeants chinois sont d'avis qu'il a violé des lois de l'Etat et diffamé ce dernier. C'est pourquoi il fait figure de criminel et a été condamné à onze ans de prison.
 
Pourtant, les gouvernements et les médias du monde occidental le portent aux nues. Voici ce que déclare le président du Comité Nobel Thorbjoern Jagland selon une information de la Deutsche Presse-Agentur (dpa) : "La constitution chinoise garantit la liberté de la presse, la liberté d'expression et la liberté de réunion, ainsi que la possibilité, pour les citoyens, de critiquer. Liu s'est borné à faire usage de ces droits; il doit être libéré." (Cité daprès le "Westfalen-Blatt" du samedi 11 décembre 2010, p. 1)
 
Comme les délits reprochés à Horst Mahler sont les mêmes, à savoir la critique de l'Etat - considérée, paraît-il, comme une diffamation de République Fédérale d©ˆAllemagne - et l'usage des libertés légitimes, la manière dont on présente publiquement le cas Xiaobo ne peut de toute évidence signifier qu©ˆune seule chose: la condamnation de Horst Mahler à douze ans de prison est illégale.
La demande de révision de son procès est déposée depuis plusieurs semaines. Il y a lieu d'espérer et d©ˆattendre qu©ˆaprès cette critique indirecte catégorique à l'encontre de la justice allemande concernant Horst Mahler ce jugement honteux soit cassé sans délai.

Nous demandons aux instances juridiques ci-dessus mentionnées d'intervenir vigoureusement dans cette affaire, dans leur propre intérêt notamment. En ce qui concerne le traitement inadmissible réservé aux détracteurs du système, la République Fédérale ne vaut pas mieux que la Chine. D'aucuns pourraient avoir l'impression que les responsables politiques de RFA sont des hypocrites ou alors qu'ils ont déjà introduit une dictature à la chinoise.
Il convient donc d'exiger la libération de Mahler à l'occasion du Nouvel An, sans grandes formalités. Toute nouvelle procédure pénale ne ferait que confirmer les pires craintes.
